This modification application has been preferred for modification of the order dated 14.10.2015 passed in Cr. Misc. No. 41534 of 2015 by which petitioner was granted anticipatory bail in connection with Khijarsarai P.S. Case No. 132 of 2014 pending in the Court of learned Chief Judicial Magistrate, Gaya in the event of his arrest or surrender within a period of six weeks from 14.10.2015.

Learned counsel for the petitioner submits that due to communication gap between the Advocate appearing on his behalf and the petitioner, he could not surrender and furnish bail bonds within the time granted vide order dated 14.10.2015 and, hence, prays for extension of time of surrender.

Patna High Court Cr.Misc. No.40546 of 2016 (2) dt.21-09-2016 2/2 In the circumstances, time to surrender granted vide order dated 14.10.2015 passed in Cr. Misc. No. 41534 of 2015 is extended for a further period of four weeks from today and the said order is modified to the extent indicated above. This modification application is, accordingly, allowed.
