JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-10-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with N.H. Bangra P.S. Case No. 69 of 2016 registered under Sections 272, 273 of the Indian Penal Code, 47 of the Excise Act and 54 of the Bihar Excise Amendment Act.

The accusation is that in course of search of the house of the petitioner, 23 bottles, each containing 750 ml., 22 bottles, each containing 180 ml. and 2 bottles, each containing 375 ml. of Country-made Foreign Liquor were recovered. Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in this case and the seizure list has not been prepared in presence of

Patna High Court Cr.Misc. No.43723 of 2016 (2) dt.18-10-2016 2/2 his family members. It is further submitted that petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Samastipur in connection with N.H. Bangra P.S. Case No. 69 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
