2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 109 (1) , 308 ( 4 ), 3(5) of BNS and 27 of Arms Act.
3 . The prosecution case in brief, is that on the alleged date and time of occurrence , while informant was at his land, in the meantime two motorcycles came in front of him and all the accused persons armed with pistols in their hand got down thereafter it is alleged that co-accused Lal Mohammad fired bullet which hit right shoulder of informant and other accused persons also fired upon informant in which one bullet hit his right abdomen and another bulltet passed near his stomach . It is
Patna High Court CR. MISC. No.27939 of 2025(2) dt.07-05-2025 2/3 further alleged that accused persons also demanded ransom of Rs. 15 lakh from informant and threatened him with dire consequences.
4. It is submitted on behalf of the petitioners that petitioner is not named in the F.I.R.,and he is own father-in -law of informant. It is a specific case of the informant that coaccused Lal Mohhamad and three unknown persons who fired upon informant. After, 10 days of the alleged occurrence a protest petition was filed by the informant in which it is stated that this petitioner along with other co-accused persons conspired and got the occurrence committed. At best, petitioner is only alleged to be conspirator. Petitioner is in no way connected with the alleged occurrence .
5 . Learned counsel for the State opposed the bail petition .
6 Considering the fact that petitioner is not named in the F.I.R., and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Begusarai in connection with Muffasil P .S.
