JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-10-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 420, 406, 467, 468, 469/34 of the Indian Penal Code.
Petitioner is alleged to have taken Rs. 65,000/- from the complainant by way of cheque for installing Tower on her land, but the same was neither installed nor the said money was returned to the complainant.
Learned counsel for the petitioner submits that the petitioner is ready to deposit Rs. 65,000/- in the Civil Court subject to outcome of the case.
Considering the undertaking of the petitioner, let the above named petitioner in the event of his arrest/surrender
Patna High Court CR. MISC. No.30910 of 2022(2) dt.10-10-2022 2/2 before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in Katoriya P. S. Case No. 120 of 2013, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
Needless to state that Rs. 65,000 would be deposited by the petitioner in the Court below and receipt to this effect shall be furnished by him while processing the bail bonds. (Prabhat Kumar Singh, J) navya/- U T
