JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Section 272, 273,34 of Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2018.

Prosecution case is that 92 liters of foreign liquor was recovered from the paddy field of Methar Mukhiya. Learned counsel appearing for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. The petitioner has been made accused in this case only on suspicion. Petitioner has got no criminal antecedent.

Learned counsel for the State opposed the prayer for bail.

Sessions Judge II, cum Special Judge Excise Act, Jhanjhapur, Madhubani in connection with Bheja Police Station Case No. 94 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
