JUSTICE RAJIV ROY ORAL ORDER 30-06-2025 Heard Mr. Suraj Narayan Yadav, learned counsel for the petitioner, Mr. Ram Chandra Prasad Bharti representing respondent no. 4 to 6 as also Ms. Sangeeta Ghosh, representing the State.

The present petition has been preferred for grant of the following relief:- "For issuance of writ in the nature of Certiorari or any other appropriate writ or writs, order and direction in respect of quashing the notice dated 12.01.2011 issued by the learned Circle Officer Kusheshwar Asthan Darbhanga whereby and where

Patna High Court CWJC No.8800 of 2014(4) dt.30-06-2025 2/3 under the learned Circle Officer Kusheshwar Asthan Darbhanga was pleased to issue notice dated 12.01.2011 in the name of dead persons."

At the outset, learned State counsel submits that the notice of 12.01.2011 has been challenged and now that the petitioner is already having status quo order persuant to the order passed by Hon'ble the Patna High Court on 02.02.2017, he should submit his reply to the said notice so that the matter could be taken to its logical conclusion. It is to be noted that the notice was addressed to his late father.

Learned counsel for the petitioner as also learned counsel for the respondent nos. 4 to 6 submits that they shall be appearing before the Circle Officer, Kusheshwar Asthan, Darbhanga pursuant to the notice dated 12.01.2011 with their respective reply so that the matter is taken to its logical conclusion.

5. A notice was issued in the year 2011, three years later, the same was challenged, now we are in the year 2025, it is high time that the matter is taken to its logical conclusion. In that background, the writ petition is disposed of granting liberty to all the necessary parties including the petitioner and the respondent nos. 4 to 6 to approach the Circle Officer,

Patna High Court CWJC No.8800 of 2014(4) dt.30-06-2025 3/3 Kusheshwar Asthan, Darbhanga with their respective affidavits/replies so that the matter is taken to its logical conclusion preferably by 31st of December, 2025.

Till the Circle Officer, Kusheshwar Asthan, Darbhanga takes the matter to its logical conclusion, the status quo granted in the present case on 02.02.2017 by a Co-ordinate Bench shall continue and will merge with the final order passed by the aforesaid Circle Officer. This is subject to the petitioner filing reply in four weeks. Failure to do so, the status quo order shall come to an end after four weeks.

7. The writ petition stands disposed of with aforesaid observations.
