27-06-2018 Heard Sri Amit Kumar Anand, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Special Excise Case No. 401 of 2018, arising out of Kasba P.S. Case No. 93 of 2018 registered for offence under Sections 272 & 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.
Learned counsel for the petitioner, at the very outset, submits that petitioner is having clean antecedent and he has falsely been implicated in the present case. It has been argued that nothing was recovered from conscious possession of the petitioner, rather from a cattle-shed of the petitioner, recovery was effected.
Patna High Court Cr.Misc. No.35417 of 2018(2) dt.27-06-2018 2/2 Besides hearing, I have also perused the material on record and after going through the same, particularly the seizure list, I do not find any ground to extend the privilege of anticipatory bail.
