2. The petitioner seeks regular bail in connection with D.R.I. Patna Unit Case No. 32 of 2022-2023, Special (NDPS) Case No. 199 of 2023 registered for the offence punishable under Sections-8(c), 20(b)(ii)©,25 & 29 of the Narcotic Drugs and Psychotropic Substances Act.

3. Allegedly, 51.900 kgs. of Ganja is said to have been recovered from the vehicle which was being driven by the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated

Patna High Court CR. MISC. No.32427 of 2024(4) dt.09-09-2024 2/2 in this case. He is merely driver of the vehicle, in question. The provisions of search and seizure of contraband was not complied with and the seizure list was prepared in the office of the informant.

5. On the otherhand, learned counsel appearing for D.R.I. has opposed the prayer for bail by submitting that commercial quantity of Ganja, has been recovered from possession of the petitioner and he was arrested at the spot.

5. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and accordingly, the same is rejected.
