The petitioner apprehends his arrest in connection with Patepur P.S. Case No.51 of 2017/G.R.No.2416 of 2017 registered under Sections 147, 149, 341, 323, 325, 307 and 379 of the Indian Penal Code.
The accusation is that over the land, which was sold by Chandri Devi, the sister-in-law of the informant Shivchandra Ram, in favour of Indu Devi, some persons started to construct the hut. When Indu Devi made protest then 16 persons, named in the F.I.R., including the petitioner having lathi and rod came there and started to commit "Maar-Peet". In course of "Maar-Peet", Indu
Patna High Court Cr.Misc. No.55142 of 2017 (2) dt.24-11-2017 2/2 Devi and her son sustained injury. At that time, this petitioner caused blood oozing injury at the head of the informant through rod and Ganesh Manjhi snatched the gold chain from the neck of the son of the informant.
Learned counsel appearing on behalf of the petitioner submits that due to land dispute, the occurrence of "Maar-Peet" took place in between the parties. While the allegation against the petitioner is to cause injury at the head of the informant through rod but one injury, as found on the person of the informant, is simple in nature. The petitioner has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-X, Vaishali at Hajipur, in connection with Patepur P.S. Case No.51 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
