09-11-2017 Smt. Bela Singh, learned counsel for the petitioner, in presence of Sri Nagendra Prasad, learned Addl. Public Prosecutor, has pressed the present petition, which has been filed for grant of anticipatory bail on behalf of the petitioner in Mahua P.S. Case No. 209 of 2017 purely on parity. She submits that one of the co-accused namely Vishwabandhu Kumar @ Bishbandhu Kumar, having similar accusation, has been extended the privilege of anticipatory bail, vide order dated 17-10-2017 passed in Cr.Misc. No. 49133 of 2017. She further submits that except implication of the petitioner on source information by the police, there is no admissible evidence on record to connect the petitioner. In the case, nothing has been recovered from the possession of the petitioner. The submission made by learned counsel for the petitioner that one of the co-accused, having similar accusation,
Patna High Court Cr.Misc. No.53586 of 2017(2) dt.09-11-2017 2/2 has been extended the privilege of anticipatory bail was not disputed by learned Addl. Public Prosecutor.
Considering the fact that co-accused, having similar accusation, has been extended the privilege of anticipatory bail, there is no reason to deny the same relief to the petitioner. Accordingly, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Sri Ram Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District & Sessions Judge-cum-Special Judge, Vaishali at Hajipur in connection with Mahua P.S. Case No. 209 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
