The petitioner apprehends his arrest in connection with Karaghar P.S. Case No. 218 of 2017, registered under Sections 406, 409, 465 and 420 of the Indian Penal Code. The accusation is that on receiving complaint by Abhay Kumar Gupta and other student, about misappropriation of money by the petitioner being the In-Charge Headmaster of upgraded Middle School, Gogahara, by putting forged signatures in the scheme for distribution of bicycle among the students. When the matter was enquired and notice was issued to Moti Lal Ram (petitioner) but he did not turn up.

Learned counsel for the petitioner submits that, in fact,

No.51851 of 2017 (2) dt.08-11-2017 petitioner was the Headmaster of Government Middle School, Gogahara and in absence of Headmaster of Upgraded Middle School, Gogahara, he was made in-charge, while the work was doing by Ashwani Kumar Singh, senior teacher of Upgraded Middle School, Gogahara, who used to do entire work on obtaining the signature of the petitioner. In fact, petitioner has no knowledge about withdrawing the money to the account of any student and at present he was retired and used to reside at his native place.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Karaghar P.S. Case No. 218 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
