2. Petitioner seeks regular bail in connection with Gaya Rail PS Case No. 45/2020 registered for the offence punishable under Sections 08/20 (B) (ii) (c) of the NDPS Act.

3. The allegation, as per First Information Report, is that total quantity of 13.250 Kilograms Ganja has been recovered from the possession of petitioner.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he has not committed any offence in the manner alleged. Learned counsel further submits that the procedure under Sections 42 and 50 of the NDPS Act has not been followed at the time of search and

5. Having regard to the submissions made by the parties and taking into consideration the material on record, I am not inclined to grant regular bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected at this stage.

6. However, petitioner may renew his prayer for bail after nine months, if the trial does not show any progress. (Anil Kumar Sinha, J) perwez U T
