JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-09-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Behiya P.S. Case No. 72 of 2020 arising out of Excise Case No. 556 of 2020 for the offences under Section 30(A) of the Bihar Prohibition and Excise Act.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent. In the instant case total 144 litres of country made liquor was seized. Learned counsel submits that the petitioner is in custody since 16.08.2020.

Considering the fact that the petitioner has no criminal antecedent, the Court is inclined to grant bail to him subject to

On depositing the amount of Rs.50,000/-, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of the 4th Additional District & Sessions Judge-cum-Special Judge Excise, Bhojpur, Ara in connection with Behiya P.S. Case No. 72 of 2020 arising out of Excise Case No. 556 of 2020. Deposit of Rs.50,000/- (Rupees fifty thousand) shall abide by final outcome of the instant criminal case.
