JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2017 No body appeared on behalf of the petitioners. It appears that earlier the prayer for anticipatory bail of that petitioners was allowed vide order dated 19.08.2017 by this Court in Criminal Miscellaneous No. 37255 of 2017 with a direction to surrender before the court below within a period of four weeks. However, It further appears that the petitioner No. 2 namely Ram Babu Ram has not surrendered within stipulated period and he has prayed for extension of further four weeks' time to surrender before the court below.
In such view of the matter, I am not inclined to interfere with earlier order passed by this Court. However if petitioner No. 2 namely Ram Babu Ram surrenders before the court below
Patna High Court Cr.Misc. No.53035 of 2017 (2) dt.15-11-2017 2/2 within a period of four weeks from receipt of order and prays for bail, the court below shall consider the same, considering the fact that he has already been granted anticipatory bail earlier, but due to some reason, he could not surrender before the court below.
