The petitioner seeks bail in a case registered under Sections 147, 149, 323, 448, 427, 337, 338, 307, 379 of the Indian Penal Code.

Allegation against the petitioner is that he assaulted the informant with butt of pistol on his head, due to which he sustained injury.

It has been submitted on behalf of the petitioner that the petitioner is in custody 26.02.2019. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. It is a case and counter case between the parties. The nature of injury

Patna High Court CR. MISC. No.27113 of 2019(2) dt.25-04-2019 2/2 is said to be simple. Hence, no offence under Section 307 of the I.P.C. is made out.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge Xcum-A.C.J.M., Patna in connection with Patrakar Nagar P.S. case No.127 of 2019.
