Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceeding. Learned counsel for the petitioner seeks permission to withdraw this application and submitted that during pendency of this application the petitioner has already been released on bail under the provisions of section 167 (2) Cr.P.C., as such this application has become infructuous.
