JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-11-2023 The present writ petition has been filed seeking the following reliefs:- "1. (i) Issuance of a direction, order or writ, including writ in the nature of Mandamus commanding the concerned respondent authorities to take steps towards considering the cases of the present petitioners, who are members of Bihar Secretariat Service towards making necessary rectification in the pay scale that has been made admissible in their favour upon implementation of the revision of

6/8 the pay scales w.e.f. 01/01/2016 pursuant to the resolution dated 24/05/2017 bearing memo no. 3590 issued from the Finance Department of the State Government, by which Bihar Secretariat Service has been declared to be at par with State services and accordingly, extend all consequential benefits in favour of the present petitioners in accordance with law;

(ii) Issuance of a direction, order or writ, including writ in the nature of mandamus commanding the concerned respondent authorities to extend the benefits of fixation of the salary of the petitioners in Level-9 upon implementation of the revised pay structure as per the resolution dated 24/05/2017 bearing memo no. 3590 and accordingly, make payment of current salary as well as arrears of salary and other consequential benefits as they may be found to be entitled to upon up-gradation of the pay scale from Level-7 to Level- 9 in accordance with the said resolution;

7/8 (iii) Issuance of a declaration holding that upon declaration of Bihar Secretariat Service to be at par with State services, the present petitioners who are working in the capacity of Assistants as members of Bihar Secretariat Service became entitled for being extended the benefits of the revision of their salary in Level-9 w.e.f. 01/01/2016 and accordingly, are entitled for being extended all consequential benefits."

At the outset, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to approach the Additional Chief Secretary, Finance Department, Government of Bihar, Patna for redressal of their aforesaid grievances. Liberty, so sought, is granted. 3.

It is needless to state that in case the petitioners approach the Additional Chief Secretary, Finance Department, Government of Bihar, Patna by filing appropriate representation, within a period of four weeks from today, the same shall be disposed off by a reasoned and a speaking
