JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 14-12-2020 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.

The prosecution case as lodged by the informant stating therein that his elder sister Soni Devi was married with one Mahendra Paswan (petitioner) about four years ago and after marriage, she was tortured for dowry and ultimately she has been killed by the petitioner and her in-law family. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that petitioner is languishing in judicial custody since 13.03.2018.

No.28623 of 2020(3) dt.14-12-2020 2/2 Considering the facts and circumstances of the case and the fact that petitioner is the husband of the victim, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected at this stage in connection with Naubatpur P.S. Case No. 80 of 2018 pending before the court of the learned Additional Chief Judicial Magistrate-II, Danapur.

However, learned court below is directed to expedite the trial preferably within a period of one year. (Anjani Kumar Sharan, J) devendra/- U T
