In this case, the petitioner is seeking anticipatory bail in connection with Special Case No. 2323 of 2019, arising out of Athamalgola P.S. Case No. 37 of 2019, registered for the offence under Section 414/34 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The Police, on secret information, raided the house of one Mohan Rai, from where 45 liter of liquor and one stolen motor-cycle were recovered and said Mohan Rai disclosed that he has purchased the aforesaid motor-cycle from the petitioner. Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the

Patna High Court CR. MISC. No.28986 of 2019(2) dt.02-05-2019 2/2 prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
