JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Patahi Police Station Case No. 70 of 1999 registered for the offences punishable under Section 376 of the Indian Penal Code. Taking note of allegation leveled against the petitioner, in my view, it is not a fit case for grant of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Patahi P.S.Case No. 70 of 1999, pending in the court of Chief Judicial Magistrate, East Champaran at Motihari stands rejected.

However, this order shall not cause any prejudice to the

Patna High Court Cr.Misc. No.43411 of 2016 (4) dt.10-01-2017 2/2 concerned court at the time of consideration of regular bail application of the petitioner.
