The petitioner seeks pre-arrest bail in connection with Amnour P.S. Case No. 17 of 2017 registered under Sections 409, 420, 120B of the Indian Penal Code and Section 7 of the Essential Commodities Act.
It is submitted by the learned counsel for the petitioner that the petitioner is neither named in the FIR nor any cogent evidence came against him for almost eight months. His name transpired during investigation on the basis of confessional
Patna High Court Cr.Misc. No.58704 of 2017 (2) dt.12-12-2017 statement made before the police by one of the drivers. He submitted that the petitioner is a P.D.S. dealer and has no concern in any manner with the alleged recovery of 35 bags of rice packed in FCI bags was loaded on two pick-up vehicles. Learned counsel for the State opposed the application for grant of pre-arrest bail to the petitioner. Considering the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Saran at Chapra in connection with Amnour P.S. Case No. 17 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
