The petitioner apprehends his arrest in connection with Govindpur Police Station Case No. 15 of 2020, registered for the offences punishable under Sections 147/148/149/188/ 291/341/323/337 of the Indian Penal Code, Section 9 of the Bihar Control of Use and Play Loudspeaker Act, 1955 and Section 37 (c) of the Bihar Prohibition and Excise Act, 2016. The allegation, as per the First Information Report, is that 16 named and 40-50 unknown persons created vandalism and pelted stones on the police party on the occasion of Saraswati Puja. It has further been alleged that the accused

No.24993 of 2020(2) dt.14-10-2020 2/3 persons were playing DJ and upon being prevented by the police party, they pelted stones and also broke the vehicle of the police standing at the place of occurrence. The police arrested four persons and the name of the petitioner along with other accused persons have been disclosed by the Dafadar.
Learned Counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and altogether 16 named accused persons and 40-50 unknown persons have been made accused in the First Information Report and the allegation against all the accused persons are general and omnibus in nature. He further submits that the petitioner has passed B. A. examination and is preparing for the competitive examination. He further submits that similarly situated coaccused persons have been granted bail by this Court vide orders, passed in Criminal Misc. Nos. 17350 and 22353 of 2020. Having heard learned Counsel for the parties and taking into consideration the materials on record and the fact that the allegation against the petitioner is general and omnibus and similarly situated co-accused persons have been granted bail by this Court, I am inclined to grant anticipatory bail to the petitioner.
This application is allowed.
Patna High Court CR. MISC. No.24993 of 2020(2) dt.14-10-2020 3/3 Accordingly, let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on bail, upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge -cum- Special Judge, Nawada, in connection with Govindpur Police Station Case No. 15 of 2020.
It is made clear that at the time of furnishing bail bonds, all the parties shall follow the guidelines regarding social distancing.
