This application is for grant of anticipatory bail for the offence under Sections 25 (1b) and a/26/35 of the Arms Act. It is submitted on behalf of the petitioner that the petitioner is neither named in the FIR nor anything has been recovered from the possession of the petitioner and the petitioner has been made accused only on the basis of the confessional statement of the co-accused, who is owner of the Vehicle. Heard learned A.P.P. also.
Having heard both sides and in view of the facts that the neither the petitioner is named in the FIR nor anything has been recovered from the petitioner as well as there is no criminal antecedent of the
Patna High Court Cr.Misc. No.45482 of 2016 (2) dt.19-12-2016 2/2 petitioner, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Smt. Divya, J.M. Ist Class, Saran at Chapra in connection with Maker P.S.Case No.54 of 2016, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, with a condition that he will co-operate in the investigation of the case as well as make himself available on each and every date, if required, otherwise his bail bond is liable to be cancelled.
