JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 12-04-2018 This application under Section 482 of the Code of Criminal Procedure has been filed by the petitioner for quashing the order dated 21.06.2014 passed by the learned Chief Judicial Magistrate, Saharsa in Saharsa Sadar P.S.Case No. 432 of 2013 corresponding to G.R.Case No. 1871 of 2013 whereby he has taken cognizance of the offences under Sections 341 and 323/34 of the Indian Penal Code and summoned the petitioners. By order dated 09.01.2018 a report was called for from the court of Chief Judicial Magistrate, Saharsa regarding the present stage of trial of Saharsa Sadar P.S.Case No. 432 of 2013. Patna High Court Cr.Misc. No.27152 of 2015 (3) dt.12-04-2018 2/2 received from the Sub-Divisional Judicial Magistrate, Saharsa. The learned Sub-Divisional Judicial Magistrate has reported that the said case has already been disposed of on 19.02.2018 under Section 320(8) of the Code of Criminal Procedure on the basis of compromise petition filed by both the parties and the accused have been acquitted accordingly.
