This application for grant of regular bail arises out of Brahmpur P.S. Case No. 18 of 2019, registered for the offence punishable under Section 30A of the Bihar Prohibition and Excise Act.

The petitioner is in custody since 07.03.2020. He had earlier approached this Court for grant of regular bail, which was rejected by an order dated 08.12.2020 passed in Cr. Misc. No. 32310 of 2020, taking into account his criminal antecedent noted in the said order. It was, however, observed that the petitioner shall be at liberty to renew his prayer for bail after six months, if, in the meanwhile, there is no substantial progress at the trial.

Learned counsel appearing on behalf of the petitioner has submitted that the stage of trial has not changed at all from

He has further submitted that if the petitioner is found involved in such activity in future, the Court may cancel his bail bonds, if granted privilege of bail in the present case. Considering the facts and circumstances and the submissions made on behalf of the petitioner, as noted above, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IInd-cum-Special Judge, Excise Act, Buxar, in Brahmpur P.S. Case No. 18 of 2019. It is indicated that if the petitioner is found indulging in such activities after his release on bail by the present order, the prosecution shall apply for cancellation of bail.
