2. The present writ petition has been filed for grant of the benefit of 1st ACP in the pay scale of Rs. 4000-6000 in place of the pay scale of Rs. 3200-4900.

3. Learned counsel for the State submits that the case of the petitioner is squarely covered by the judgment dated 26.04.2024 passed by the Hon'ble Division Bench in LPA No.

Patna High Court CWJC No.7218 of 2025(2) dt.23-03-2026 2/3 458 of 2021 arising out of CWJC No. 1744 of 2020. Learned counsel for the petitioner further submits that for redressal of his grievance, the petitioner has already submitted a representation dated 01.02.2025 before the Deputy Inspector General of Police, as contained in Annexure P/5 to the writ petition, but no decision has been taken thereon till date.

4. Learned counsel for the State submits that a counter affidavit has been filed and that the respondent authority is inclined to decide the representation of the petitioner in the light of the decision rendered in LPA No. 458 of 2021.

In the aforesaid background, the petitioner is directed to file a fresh representation before respondent No. 4, namely, the Deputy Inspector General of Police, Bihar Special Armed Police, Central Zone, Patna, along with a copy of this order, within 30 days from today. Upon receipt of the representation, respondent No. 4 is directed to take a decision thereon within 90 days from the date of its filing, by passing a reasoned and speaking order. Needless to say, if it is found that the case of the petitioner is squarely covered by the judgment rendered in LPA No. 458 of 2021, the petitioner shall be granted the benefit of the same within a further period of 90 days thereafter.

6. With the aforesaid observation and direction, the writ petition stands disposed off.
