This is a petition for grant of anticipatory bail for offence under Sections 188, 420 and 34 of the Indian Penal Code and 47, 47(a) and 48(2) of the Bihar Excise (Amendment) Act, 2016.

From a vehicle foreign liquor was recovered, when the vehicle made with an accident. The driver disclosed that the petitioner was involved in the business.

Submission of the petitioner is that the petitioner is not the owner of the vehicle. The occurrence allegedly took place on 25.08.2016.

Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Amnour P.S. Case No. 152 of 2016 to the satisfaction of Sri Amrendra Prasad, Judicial Magistrate, 1st Class, Saran at Chapra, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
