Petitioner is seeking anticipatory bail in connection with Bihta P.S. Case No.520 of 2017 registered for offences punishable under Sections 147, 148, 149, 406, 379 and 120B of the Indian Penal Code, Section 4/21 of the Bihar Mines Minerals (D&R) Act, 1957, Section 4/40 of the Bihar Mines Minerals Concession Rule, 1972 and Section 8 of the Bihar Minerals and Prevention of Illegal Mining Transportation Rules, 2003. Learned counsel for the petitioner submits that petitioner is not named in the FIR, but because in the seizure list petitioner's Poklen machine is also shown as one of the machines seized by the raiding party, the petitioner is apprehending his

Patna High Court Cr.Misc. No.53890 of 2017 (2) dt.09-11-2017 arrest. It is submitted that the FIR named persons, whose machines were also seized, have been granted the privilege of anticipatory bail in the various cases such as Cr.Misc.49634 of 2017 and Cr.Misc.No.51436 of 2017. It is submitted that there is one case against this petitioner as stated in paragraph 3 of the application and he is on bail in the said case.

In the facts and circumstances, in case of arrest or surrender of the petitioner within a period of four weeks from today, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur in connection with Bihta P.S.
