JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-01-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Bodh Gaya P.S. Case No. 17 of 2020 for the offence under Sections 399, 402, 411 of the Indian Penal Code and Section 3/4 of the FEMA Act, 1999.

Learned counsel for the petitioner submits that the provisions of the FEMA Act are not applicable in the case. It is further submitted that the name of the petitioner surfaced on the confessional statement of co-accused and he has remained in custody for about one year.

Considering the fact that the petitioner is in custody since 14.01.2020, the Court is inclined to grant bail to him. The

Patna High Court CR. MISC. No.29292 of 2020(3) dt.04-01-2021 2/2 petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S. Case No. 17 of 2020.
