JUSTICE ARUN KUMAR ORAL ORDER 09-11-2017 Heard learned Counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with Su8paul PS Case No. 446 of 2017 registered under Sections 363, 366A/34 of the IPC.

The allegation is that the petitioner kidnapped the minor daughter of the informant.

Learned Counsel for the petitioner submits that the petitioner and the informant's daughter were in love relationship and both eloped away and now both are living as husband and wife.

It appears that the victim made her statement under Section 164 Cr.P.C and reiterated the allegation of kidnapping as well as of committing rape and found pregnant. Having considered the said facts and circumstances the

Patna High Court Cr.Misc. No.52908 of 2017 (2) dt.09-11-2017 prayer for anticipatory bail of the petitioner stands rejected. The petitioner is directed to surrender and seek regular bail which shall be considered on its own merit without being influenced by the present order.
