2. This application has been filed, under Article 226 of the Constitution of India, seeking direction to the respondents-authorities to permit the petitioner to officiate and run the educational centre at Rajkiya Madhya Vidyalaya,

Patna High Court CWJC No.9849 of 2015 dt.23-01-2018 2/2 Borwal, Block-Bagaha-II, in the district of West Champaran, as, according to the petitioner, she was selected as 'Sawaym Sevika' at Talimi Markaj Shiksha (Educational Centre) on 19.08.2013, on being found most eligible and fittest candidate for the said post.

3. A counter affidavit has been filed on behalf of respondent Nos. 3 to 5, which has been sworn by the Block Education Officer, Bagaha-II, West Champaran.

4. It appears from the said counter affidavit that the averments made in the writ application have not been disputed. It is not clear from the said counter affidavit as to what is the ground for denying the petitioner's claim. It seems that the said counter affidavit has blamed the inaction of the then Block Education Officer, Bagaha-II, West Champaran.

6. In such circumstance, I dispose of the writ application with a direction to the District Magistrate, West Champaran, Bettiah, to look into the matter and ensure that an appropriate decision is taken within a period of two months from the date of receipt/production of a copy of this order.
