This application for regular bail arises out of Bakhtiyarpur P.S. Case No. 64 of 2020, disclosing the offence punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act.

Prayer of the petitioner for grant of regular bail was earlier rejected by an order of this Court dated 02.12.2020 passed in Cr. Misc. No. 31533 of 2020 with an observation that the petitioner shall be at liberty to renew his prayer for bail after six months considering the nature of accusation against the petitioner and his criminal antecedent, the bail application was earlier rejected by this Court.

Learned counsel appearing on behalf of the petitioner has drawn my attention to various orders passed by this Court, whereby similarly circumstanced persons have been directed to

Patna High Court CR. MISC. No.39595 of 2021(2) dt.11-08-2021 2/2 be released on bail. Statement to this effect has been made in paragraph 10 of the present application.

Considering the above submission and the petitioner's custody since 25.02.2020, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Barh, Patna, in Bakhtiyarpur P.S. Case No. 64 of 2020.
