The petitioner apprehends his arrest in Bairgania P.S. Case No.142 of 2016 registered under Sections 311, 406, 420, 467, 468, 471 of the Indian Penal Code.

The informant filed a complaint case on the basis of which the present F.I.R. was lodged. The informant in his complaint petition alleged that Niyaz Ahmad, Md. Mustaquim Ansari, Afak Ahmad and his manager, Sonu Ram(the petitioner) on the assurance of getting them employed in Arab country took money for the purpose of preparation of passport and visa but they did not give passport and visa nor took them to Arab country for employment.

Afak Ahmad undertook to return the entire money to the informant within four months and on such, Md. Mustaquim Ansari and Md. Afak Ahmad have been granted anticipatory bail vide order dated 20.11.2018 passed in Cr. Misc. No.50900 of 2018. The petitioner is manager of Md. Mustaquim Ansari and Md. Afak Ahmad. Petitioner did not receive any money.

Taking into consideration the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Bairgania P.S. Case No.142 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
