The petitioner prays for anticipatory bail in connection with Khagaria Chitragupta Nagar PS case no. 08 of 2010 registered for the offence punishable under sections 420, 120B/34 of the Indian Penal Code.
It is submitted on behalf of petitioner that petitioner is not named in the FIR and location of mobile no. shows that it is of the petitioner and petitioner has falsely been implicated in this case.
Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail and stated that his name transpires during the course of investigation.

In view of the facts stated above let the abovenamed petitioner, in the event of his arrest or surrender before the Court below within a period of six weeks, be released on provisional bail till filing of the chargesheet on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Khagaria Chitragupta Nagar PS case no. 08 of 2010 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with a condition that petitioner must cooperate in the investigation of the case and after submission of charge-sheet, petitioner may move before the learned court below for regular bail which will be considered on the materials available in the case diary at that time. With these observations, this bail application is disposed of.
