2. The petitioner seeks regular bail in connection with Alamganj P.S. Case No. 366 of 2025 registered for the offence under Section 309(6) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the petitioner and others are accused of assaulting the informant and her family members, causing head injuries, and snatching one mobile phone.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The petitioner is in custody since 01.05.2025. It is further submitted that nothing has been recovered from the possession of the petitioner.

5. Learned counsel for the State vehemently opposes

6. There exists prima facie material against the petitioner indicating his involvement in the commission of the offence. The victim Gayatri Kumar, wife of Amit Kumar, identified the petitioner during TI Parade. The involvement of the petitioner has come during investigation that he was present along with the motorcycle to commit the crime. The petitioner has four criminal antecedents.

7. Considering the nature and gravity of the accusation, this Court is not inclined to grant regular bail to the petitioner. Accordingly, this application for regular bail stands rejected.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
