JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-08-2019 This application, for grant of anticipatory bail, arises out of Ara Nawada P.S. Case No. 645 of 2018, disclosing offences under Sections 406, 419, 420, 465, 467, 468 and 120(B)/34 of the Indian Penal Code.

Prosecution case as per complaint petition is that petitioner impersonating the father of the informant got his sale deed executed in favour of his father's name. Submission of learned counsel for the petitioner is that after seven years of execution of sale deed, the present case has been filed and the land in question has been mutated in the name of father of the petitioner and on the complain of the informant, enquiry was also done but the enquiry officer has found that the land in question has been in possession of the

Heard learned A.P.P. as well as learned counsel for the informant. Learned counsel for the informant has opposed the prayer for bail and submitted that earlier he was not aware with regard to fraud committed by the petitioner and as soon as he came to know, he lodged the case.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara, Bhojpur/ or the concerned court, where the case is pending, in connection with Ara Nawada P.S.
