The petitioner apprehend his arrest in connection with Mohania P.S. Case No. 166/2020 registered for the offences punishable under Sections 341/323/307/504/506/34 of the Indian Penal Code.

As per the FIR, due to some petty dispute between the parties over the passage of water mar-pit took place in which it is alleged that the petitioner has assaulted the informant with fists and slaps and also with lathi and danda. It is submitted on behalf of petitioner that there is case and counter case between the parties and there is inordinate delay in lodging the FIR for which no plausible explanation has been given and there is general and omnibus allegation against

Patna High Court CR. MISC. No.29102 of 2020(3) dt.05-01-2021 2/2 this petitioner and injuries have been found to be simple in nature. The petitioner has got clean antecedent as stated in paragraph No. 3 of the petition.

Considering the aforementioned facts and circumstances, the bail application of this petitioner is allowed. Let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Mohania P.S. Case No. 166/2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
