JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and learned counsel for the complainant, who has suo motu appeared in the case.
The petitioner seeks pre-arrest bail in connection with Complaint Case No.3964(C) of 2017 dated 15.09.2017 in which cognizance has been taken vide order dated 17.02.2018 under Sections 406 and 120B of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that the petitioner had no knowledge regarding any agreement between the complainant and the builder Kalendra Narayan Singh. The entire amount as alleged in the complaint petition has been paid either in the bank account of Kalendra Narayan Singh or in
Patna High Court Cr.Misc. No.35225 of 2018 (2) dt.28-06-2018 2/2 the bank account of Priyanka Ranjan. The only allegation against the petitioner is that after pressurising the complainant rupees seventy five thousand in cash was taken from him at the time of registry. It is submitted that the allegation made by the complainant is completely false. The petitioner is an old lady aged about sixty years and has got no criminal antecedent. Learned counsel for the complainant has vehemently opposed the application for grant of pre-arrest bail to the petitioner. He has submitted that the petitioner was hand in gloves with the builder and they jointly duped the complainant and after taking money failed to hand over the flat in question.
Be that as it may, considering the nature of allegation, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna in connection with Complaint Case No.3964 (C) of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
