Mr. Md. Irshad, A.C. to S.C.1 while objecting to the reliefs submits that although the petitioner was made to superannuate with effect from 31.8.2000 vide letter No. 379 dated 18.8.2000 and this order was questioned by the petitioner in C.W.J.C. No. 13757 of 2006 but the writ petition was disposed of on 7.12.2004 as admitted by him at paragraph 8 for taking recourse to the proper remedy. He submits that the petitioner admits that he filed a suit before the Munsif bearing No. 21 of 2006 which is yet pending. According to Mr. Irshad, the writ petition is barred on the principles of res judicata.
