JUSTICE BIRENDRA KUMAR ORAL ORDER 09-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341,342,323,332,333,353,147,149,504,506,306 of the Indian Penal Code.

The petitioner was driver of the Hiva vehicle which was carrying stone and when the informant police party intercepted and asked to take the vehicle to the police station other co-accused scuffled with the police party.

Submission is that there is no allegation against the petitioner to have caused obstruction in discharging of official

Let, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas/Successor Court in connection with Shivsagar P.S. Case No. 148 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
