29-06-2018 Heard Sri Hari Kishore Thakur, learned counsel for the petitioner and Sri Navin Kumar Pandey, learned Addl. Public Prosecutor.
The sole petitioner, having clean antecedent which fact has been stated in paragraph - 3 of the petition, apprehending his arrest in Excise Case No. 65 of 2018 registered for offence under Sections 30(a) and 38 of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.
Learned counsel for the petitioner submits that nothing was recovered either from conscious possession of the petitioner or from premises, rather in the case, from an open field, which was on backside of the hotel of the petitioner, there
Patna High Court Cr.Misc. No.36642 of 2018(2) dt.29-06-2018 2/2 was recovery of about 3.375 liter of Indian make foreign liquor and petitioner has falsely been made accused in the present case. Considering the nature of accusation as well as clean antecedent of the petitioner, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner namely Mahesh Sahani @ Mahesh Sahni @ Mhesh Sahani be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Excise Case No. 65 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
