JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-05-2024 The present writ petition has been filed seeking the following relief:- "1. That the present writ petition is being filed for a direction upon the concerned respondents, particularly respondent no. 5 to remove the encroachment, encroached by anti social elements of the Aam Rasta which falls in Mauza-Meura, Khata No.- 40, Plot No,-77, Area-2.61 Acre, used by the people generally and by
Patna High Court CWJC No.10984 of 2014(2) dt.01-05-2024 2/3 the petitioner particularly as egress from his house.
The said encroachment causes great hardship to the petitioner, as the same is the only way out of his house.
The aforesaid encroachment has not been removed notwithstanding a finding given in Misc. Case No.- 26/07-08 instituted for this purpose on complaint made by the petitioner before respondent no. 5 that encroachment has been made on the public land and the same should be removed. In fact, notices were Issued to the concerned parties to remove the encroachment but nothing has been done and the said encroachment has not been removed till date and the encroachers are expanding their area of encroachment with Impunity. The matter is languishing since 2003 for the reason best known to the concerned respondents."

At the outset, the learned counsel for the respondent-State submits that the encroachment in question has already stood removed, however, the same is refuted by the learned counsel for the petitioner, hence he seeks liberty on behalf of the
Patna High Court CWJC No.10984 of 2014(2) dt.01-05-2024 3/3 petitioner to approach the Circle Officer, Kochas, District-Rohtas at Sasaram, for redressal of his subsisting grievances, if any. Liberty, so sought, is granted.

The writ petition stands disposed off.
