The petitioner prays for anticipatory bail in connection with Tariyani P.S. case no. 97 of 2016 registered for the offences punishable under Sections 387, 307/34 of the Indian Penal Code.

It has been submitted on behalf of petitioner that except that he has ordered, there is no allegation of overt act against him.

Heard learned A.P.P. also.

Considering the fact that informant has not committed any overt act except that he is a order-giver, let the abovenamed petitioner, in the event of his arrest or surrender

Patna High Court Cr.Misc. No.51725 of 2016 (2) dt.21-12-2016 2/2 before the Court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate, Sheohar in connection with Tariyani P.S. case no. 97 of 2016 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
