07-10-2020 Heard learned counsel for the petitioner as well as learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in Nawada (Town) P.S. Case No. 248 of 2020, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act. Two bottles of 300 Ml. of country-made liquor is said to have been recovered from beneath the stairs of petitioner's house.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Recovery has been made from a place, which is accessible to general public. The house is in joint possession of the family. It is stated in paragraph - 3 of the petition that petitioner has got clean antecedent.

In the event of his arrest or surrender within a period of eight weeks from the date of receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II cum Special Judge, Nawada, in connection with Nawada (Town) P.S. Case No. 248 of 2020, subject to condition as laid down under Section 438(2) of the Cr.P.C.
