JUSTICE BIRENDRA KUMAR ORAL ORDER 20-12-2016 Heard the learned counsel for the petitioner and the State.
This is a petition for grant of anticipatory bail for offence under Section 409 of the Indian Penal Code. The petitioner is a Government servant and was working as Panchayat Secretary. Allegation is that he did not produce the service folder of the teachers appointed on contract. Submission of the petitioner is that this may be a case of subordination of Government servant making him liable to disciplinary proceeding. However, no criminal case is made out. Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Ghosi P.S. Case No. 85 of 2016 to the satisfaction of the Chief Judicial Magistrate, Jehanabad, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
