2. It appears from the perusal of the record that the present application has been filed against the order dated 22.07.2016 passed by the learned Additional Sessions JudgeVII, Patna City, Patna in S. Tr. No.893 of 2015 arising out of Alamganj P.S. Case No.89 of 2015 whereby the petition filed under Section 227 of the Code of Criminal Procedure for discharge has been rejected.

3. On perusal of report of the learned trial court, it appears that now charge has already framed in this case and matter is pending for examination of witness.

4. The matter is of year 2015, which is now running at the stage of examination of prosecution witness and, as such, the present petition has become infructuous, with change in stage of proceedings.

5. Accordingly, the petition stands dismissed being infructuous.
