Learned counsel for the petitioners undertakes to remove the defects within three weeks. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 30(a), 30(d) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioners submits that petitioners are innocent and have been falsely implicated in this case. He submits that there is no recovery from the conscious possession of the petitioners rather 35 liters of country made

Patna High Court CR. MISC. No.29955 of 2022(2) dt.08-09-2022 2/2 liquor and some utensil are said to have recovered from the bank of river. He submits that the petitioners have been made accused on the basis of statement of local people. He further submits that petitioners have no criminal antecedent as stated in para-3 of the bail application.

Considering the facts and circumstance of the case and the fact that petitioner is a member of syndicate who indulged in manufacturing of illegal liquor, I am not inclined to enlarge the petitioners on bail. Accordingly, their prayer for anticipatory bail is rejected in connection with Jagdishpur P.S. Case No. 10 of 2022.
