====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-12-2020 Heard learned counsel for the parties through Video Conferencing.
Petitioners apprehend arrest in a case registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code.
As per the prosecution case, the daughter of the informant was married with co-accused, Gopal Rai, about 14 years ago. It is further alleged that after the marriage, all the accused persons including these petitioners used to torture the deceased and demanded dowry in the form of money and due to non-fulfillment of the same, she was killed by all the accused persons including these petitioners.
Patna High Court CR. MISC. No.24592 of 2020(4) dt.08-12-2020 2/2 Petitioner No.1 is father-in-law of the deceased, aged about 70 years, and Petitioner No.2 is mother-in-law of the deceased, aged about 67 years.
It is submitted on behalf of the petitioners that there is general and omnibus allegation and thrust of acquisition is against the husband of the deceased. Petitioners are living separately and petitioner no.1 is suffering from paralysis. However, learned A.P.P. for State has vehemently opposed the prayer for bail.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioners is allowed. In the event of arrest/surrender, let the petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate First Class, Danapur in Maner Police Station Case No.131 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
