In this case, the petitioner is apprehending his arrest in connection with Lalganj P.S. Case No. 172 of 2016 registered for offences under sections 379 and 411 of the Indian Penal Code.

As per allegation made in the First Information Report, a truck, loaded with material, was stolen and, ultimately recovered from Mubarak Ali who in his statement under Section 164 of the Cr.P.C. has stated that he in presence of the driver, namely, Naresh Giri and others including the petitioner, has unloaded the material from the truck.

Learned counsel for the petitioner submits that the petitioner has no concern with the material and wrongly he has

Patna High Court CR. MISC. No.31500 of 2019(2) dt.13-05-2019 2/2 been implicated in the present case on account of business rivalry but, in paragraph no.4, there is no specific statement with respect to business rivalry. The petitioner has criminal antecedent of the same nature of offence.

Looking to the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner, above named, is rejected.
