JUSTICE SANDEEP KUMAR ORAL ORDER 25-03-2022 Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Garkha P.S. Case No. 83/2020 registered for the offences punishable under Sections 420/406/506 of the Indian Penal Code.

Learned counsel for the petitioner submits that he is ready to return the disputed amount to the informant. Considering the aforesaid submission, the prayer of the petitioner for grant of anticipatory bail is allowed.

No.39109 of 2021(2) dt.25-03-2022 2/2 Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM,XIV, Saran at Chapra, in connection with Garkha P.S. Case No. 83/2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

It is directed that at the time of furnishing bail bond, the petitioner shall deposit demand draft of Rs. 98,600 (Ninetyeight Thousand Six Hundred) only in the name of the informant in the court below which shall be released in favour of the informant. On the amount being deposited by the petitioner, the petitioner shall be released on anticipatory bail and the Court below shall, thereafter, consider the possibility of dropping criminal case in view of the demand of the informant being satisfied.

With the aforesaid direction and observation, this application is allowed.
